Rule of law?

For the moment, the Navy can't deafen marine mammals that may or may not be able to survive with impaired hearing. The reason: It's illegal. Even the government has to obey the law.

But only the 9th circuit has said so. The Supremes will probably overrule.

My favorite part of the Navy's PR response is this:

"We're a country engaged in two wars. When we send America's sons and daughters into harm's way, we must ensure they have the best possible training," [spokeswoman Lt. Cmdr. Cindy Moore] said.

Yeah, that al Qaeda navy is really intimidating!
